Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Guest Guide. By creating an account or using the Service, you agree to be bound by these Terms.

1. About Us

Guest Guide (“we”, “us”, “our”) is operated by Guest Guide, 9 Lansdowne Crescent, Derry Hill, Calne, SN11 9NT. You can contact us at admin@guestguide.live.

2. The Service

Guest Guide is a software-as-a-service (SaaS) platform that allows holiday let owners and property managers (“you”, “your”) to create, manage, and share digital welcome guides for their properties. The Service includes AI-assisted content generation, guide publishing, and QR code or link-based sharing.

3. Eligibility

You must be at least 18 years old and a resident of the United Kingdom or another jurisdiction where the Service is available to use Guest Guide. By registering, you confirm that all information you provide is accurate and that you have the authority to enter into these Terms.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at admin@guestguide.live if you suspect any unauthorised use of your account. We will not be liable for any loss arising from unauthorised access that results from your failure to keep your credentials secure.

5. Subscription Plans and Payment

Guest Guide is offered on a subscription basis. The current plans and prices are shown on our Pricing page and are inclusive of VAT where applicable. Plans are billed monthly in advance.

Free trial: New accounts receive a 14-day free trial. No payment details are required to start your trial.
Billing: After the trial period, continued use of paid features requires an active paid subscription.
Price changes: We will give you at least 30 days’ notice of any price increase before it takes effect.
Cancellation: You may cancel your subscription at any time. You will retain access until the end of your current billing period; no refunds are given for the unused portion of a period.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

Use the Service to publish or distribute any content that is unlawful, harmful, defamatory, or infringes the rights of any third party
Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure
Use automated scripts or bots to access or scrape the Service
Resell or sublicense the Service to third parties without our written consent
Use the AI content generation feature to produce misleading or fraudulent content

We reserve the right to suspend or terminate your account immediately if we reasonably believe you have breached this clause.

7. Your Content

You retain ownership of all property descriptions, text, and other content you upload or create using the Service (“Your Content”). By using the Service, you grant us a limited, non-exclusive licence to host, store, and display Your Content solely for the purpose of providing the Service to you.

You are solely responsible for ensuring that Your Content does not infringe any third-party rights or applicable laws. We do not routinely monitor content but reserve the right to remove any content that we are notified may breach these Terms or applicable law.

8. AI-Generated Content

The AI content generation feature produces draft text based on your property description. AI-generated content is provided as a starting point only. You are responsible for reviewing, editing, and verifying all published content for accuracy, completeness, and appropriateness before sharing it with guests. We make no warranty regarding the accuracy or suitability of AI-generated outputs.

9. Intellectual Property

The Service, including all software, design, text, graphics, and branding, is owned by or licensed to Guest Guide and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you. You may not copy, modify, reverse-engineer, or create derivative works of the Service without our prior written consent.

10. Availability and Modifications

We aim to provide a reliable service but do not guarantee uninterrupted or error-free access. We may carry out maintenance, updates, or changes to features at any time. Where we intend to make a material change that affects your use of the Service, we will give reasonable advance notice where practicable.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Guest Guide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total fees paid by you to us in the three months preceding the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Indemnity

You agree to indemnify and hold harmless Guest Guide and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal costs) arising from your use of the Service, Your Content, or your breach of these Terms.

14. Third-Party Services

The Service integrates with third-party providers including Microsoft Azure (hosting and AI) and an email delivery provider. We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party services may be subject to their own terms and privacy policies.

15. Termination

Either party may terminate the agreement formed by these Terms at any time. We may suspend or terminate your account immediately if you breach these Terms, fail to pay applicable fees, or if we are required to do so by law.

On termination, your right to access the Service ceases. We will retain your data for a period as described in our Privacy Policy and then delete it, unless required by law to retain it longer. You may export your guide content before closing your account.

16. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms.
